1. This Promotion is open to those aged 18 or over, excluding families of the Promoter, agents or anyone else professionally connected with this promotion, 2. No purchase necessary however a valid Facebook or Instagram account and internet access is required. 3. Promotion Period: Enter between 12 noon CET on 22nd June 2015 and 12 noon CET on 28th August 2015.

4. To Enter: Either: a. Log on to your Facebook account (or create one for free) and go to Europcar’s Facebook page www.facebook.com/europcar using the Facebook App or go to www.myeuropcarroadtrip.com. Fill in your name and email address then upload a picture or video (this can be in the form of sketch, a parody or song of your own creation) of a road trip moment that you would share with your friends, family, pets, or experience by yourself. The picture or video must be taken from inside an automotive vehicle. OR, b. Log onto your Instagram account (or create one for free), follow @europcar then upload a picture or video (this can be in the form of sketch, a parody or song of your own creation) of a road trip moment that you would share with your friends, family, pets, or experience by yourself. The picture or video must be taken from inside an automotive vehicle with the hashtag #MyEuropcarRoadTrip. Instagram entries that do not contain the hashtag will not be valid. 5. Any music that is used in entries must be taken from Spotify’s playlist of the ‘My Europcar Road Trip competition’. 6. Facebook entrants can invite a maximum of 50 of their friends on Facebook, to also take part in the Promotion once they have applied. For every 10 friends invited, they earn an extra vote on their picture or video. 7. Those entering via Instagram must continue to follow @europcar after the end of the Promotion Period so that they can be contacted if you are a winner. 8. By entering the promotion, entrants give their permission for their photos and videos to be used by the Promoter without further compensation for up to one year for promotion purposes. This includes photo and video entries in the competition and photos taken with FotoMate (see clause 11). Copyright will remain with the entrant. However, by entering this promotion, the entrant agrees to the Promoter publishing these entries on their website and possible further use on their website, Facebook, Twitter, YouTube and Instagram. They also agree to other possible promotional use in media of the promoters choosing without any payment but with appropriate credit given to the original entrant for up to one year. 9. All entries must be received by the end of the Promotion Period to be valid and no liability is accepted for illegible, incomplete or late entries. 10. Maximum one entry per person via either Facebook or Instagram during the Promotion Period. Any further entries submitted by one person will not be accepted and are ineligible to win. 11. The Prizes: a. Grand Prize: 1 winner will win 1x road trip for 2 people, to the value of 15,000€ taxes included. b. Second Prize: 75 winners will each win 1x camera by Ricoh Imaging, to the value of 299€ taxes included for each camera. c. Third Prize: 500 winners will each win a code for films by FotoMate. This is a new app where you can take photos with your smartphone and receive printed versions in the mail. Each winner will receive a promotional code for 1 ‘film’ (5 photos), to the value of 7.20€ taxes included each. 12. Further Grand Prize Details: The road trip will be tailored depending on the home country of the winner. The Prize may include the following: a. Automobile with fuel; and b. Airplane tickets; and c. Budget for accommodation. This is not and exhaustive list and will vary. The winner will be informed of the exact details once they have been during Winner Notification. 13. The FotoMate codes will expire within one year. 14. The pictures taken with FotoMate are subject to moderation. Pictures that are considered inappropriate or obscene by the moderators will not be processed by FotoMate. Depending on the number of pictures that did not pass the moderation phase, the winners will receive the top 1 to 5 pictures of the competition by mail. 15. The prizes are non-transferable, are not exchangeable and have no cash alternative. 16. The Promoter reserves the right to offer alternative prizes, of equal or greater value, should the advertised prizes become unavailable for reasons beyond their control. Please allow up to 60 days for delivery of Second and Third prizes from winner confirmation. 17. Moderation: Entrants must only submit images that are their own work. The Promoter will reject entries which, in the reasonable opinion of the Promoter: a. contain any content that is likely to be considered offensive by the Promoter or could reflect negatively the name, reputation, or goodwill of the Promoter or any brand partner; b. have been previously published or won an award or prize via a promotion run by the Promoter or any other entity. c. include trademarks, logos, or copyrighted material not owned by you or used without the right holder's prior written permission (including famous names, company names, etc.); d. defames, misrepresents, or insult other people or companies, including, but not limited to the Promoter (including its partners); e. promotes any political agenda; f. Do not comply with road safety legislation (e.g. a photograph taken when the Participant was driving his/her vehicle will be automatically rejected); g. Damage the reputation, private life and image of third parties; h. Are of a pedophilic nature; i. Offend the sensitivity of minors; j. Are of a pornographic nature; k. Are injurious to the security or integrity of a State or territory; l. Incite discrimination based on gender, religion, nationality, disability, sexual orientation, age or political opinions; m. Incites crime, hatred, violence, suicide or racism; n. Incites the committing of a crime, wrongful act or act of terrorism. 18. All entries will be uploaded onto YouTube for the public to vote for the winners after moderation (see clause 17). Voters will be able to vote for an unlimited number of entries but only 1 vote can be used per picture or video. Facebook entrants will be able to earn extra votes on their entries, see clause 6. 19. In compliance with the provisions of article 9 of the French Civil Code, the Participant expressly authorises the Promoter, free of charge, to post, circulate, reproduce, represent and modify the images, for any use, on the Promoter’s Facebook, YouTube and Instagram sites. 20. This authorisation to use is granted free of charge and worldwide, with effect from sending of the images by the Participant, for a period of six (6) months.. 21. Winner Notification: The winners will be the ones with the most votes at the end of the voting period to either receive a Grand Prize, Second Prize or Third Prize. Winners will be contacted via the email address provided upon entry if they entered through the Facebook app, or by responding to their picture in the comment section or with a private message, if they entered through Instagram, within 10 working days. The winners will then be required to respond to confirm eligibility plus acceptance of the prize within 7 days of initial contact. In the event a winner does not respond to communications within the 7 days of initial contact, the Promoter reserves the right to disqualify that winner and allocate that prize to the next highest ranking winner. 22. The Promoter will only use the personal details supplied for the administration of the promotion and for no other purpose, unless we have your consent. Click to see our privacy policy here. 23. Pursuant to French law pertaining to the data collection and processing, entrants have a right of access to, modification and withdrawal of their personal data. They also have a right to oppose such collection of their personal data under certain circumstances. To exercise such right, you may write to the Promoter. The data controller and data recipient is the Promoter. Your data will not be transferred outside the European Union. 24. Bulk entries or votes made from trade, consumer groups or third parties will not be accepted. Incomplete entries, entries or votes submitted by or via third parties or syndicates, entries or votes submitted by macros or other automated means, and entries which do not satisfy the requirements of these terms and conditions in full will be disqualified and will not be counted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase the votes of that participant’s entries in a way that is not consistent with the spirit of the promotion, that participant’s entries will be disqualified and any prize awarded will be void. 25. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or Spotify. You understand that you are providing your information to the Promoter and not to Facebook, Instagram or Spotify, and that Facebook, Instagram and Spotify have no liability for any element of this promotion. 26. To the extent permitted by law, the Promoter shall not be liable to the winners for any loss or damage whatsoever caused (whether in contract, tort (including (without limitation) negligence), statutory duty or otherwise) arising out of or in connection with the competition and prize. 27. The Promoter or its agencies will not be responsible for the non-inclusion of entries or votes as a result of technical failures or otherwise, including any such failure which is within the control of The Promoter or its agencies. Proof of submission of entry is not proof of receipt of entry. The Promoter accepts no responsibility for system errors or other issues that may result in disruption to lost, delayed or not received entries, votes or winner notifications. 28. In the event of any dispute the decision of the Promoter is final and no correspondence will be entered into. 29. The winner will be requested to participate in reasonable publicity arising from the promotion. 30. By entering the promotion, entrants confirm that they have read and agree to be bound by these terms & conditions and by the decisions of the Promoter, which are final in all matters relating to the promotion. Failure to do so will result in the forfeiture of the prize. 31. If for any reason the Promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion. 32. If an act, omission, event or circumstance occurs which us beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation. 33. The name and country of the Grand Prize winner will be available by sending an email to socialmedia.group@europcar.com 2 months after the Promotion Period. 34. Participation in the Promotion implies full and entire acceptance of these rules and regulations. Any claim regarding the Promotion must be sent in writing to the address of the Promotion, indicating the contact information of the Participant, and must reach the Promoter at the latest one month after the Promotion has been closed. Any dispute or disagreement regarding the interpretation or application of these rules and regulations will be settled by the Promoter under the control of the bailiff with whom the rules and regulations are lodged and after having received his/her advice. The decisions of the Promoter will be final and no appeal will be allowed. 35. The responsibility of the Promoter may not be sought in relation to any incidents that may arise on account of the use or benefit of the allocated prize, except to apply legal public policy provisions. The Promoter reserves the right, for any reason whatsoever, to shorten, extend, defer or cancel the Promotion or to modify the conditions of access thereto and/or the terms of operation. The Participants may not claim any compensation. Any change will be notified in advance using any appropriate means. Modifications to the rules and regulations may be published during the Promotion.
